SERMENT

Attestation solennelle, devant Dieu, de la vérité d'une déclaration ou du sérieux d'un engagement, le serment entraîne l'acceptation au moins implicite d'une malédiction divine pour le cas où la déclaration serait fausse ou l'engagement rompu. Ainsi défini, il s'inspire du sentiment d'une absolue dépendance à l'égard du Dieu très saint, Dieu de vérité et souverain Juge. Aussi n'est-il pas interdit par la Loi, qui n'en condamne que le mauvais usage. (cf. Ex 20:7, Le 19:12, Am 8:14, Os 4:15) L'habitude de prêter serment était très répandue chez les Juifs, non seulement devant le juge lors d'un procès, mais même dans les relations ordinaires de la vie quotidienne.

On peut en distinguer plusieurs genres :

1. Le serment d'adjuration, par lequel on sommait quelqu'un, sous menace de la malédiction divine, de dire toute la vérité ; d'où les deux expressions synonymes : « entendre un serment » et « entendre une malédiction ». C'était la sommation d'usage avant les débats judiciaires, et celui à qui elle s'adressait répondait simplement par « amen, amen » (=en vérité). On en connaît un exemple célèbre, au procès de Jésus (Mt 26:63).

2. Le serment proprement dit, par lequel on se liait soi-même de la façon la plus rigoureuse, voire avec imprécations appelant le châtiment si l'on ment (par ex. le serment de Pierre, dans la scène du reniement, Mt 26:72-74).

3. Le serment dit de purification, qu'on prononçait si l'on était soupçonné de vol ou de dégradation du bien d'autrui, quand tout témoin faisait défaut.

4. Citons encore le serment de fidélité à Dieu et au roi, et les serments par lesquels on scellait une alliance ou un traité quelconque, serments qui pouvaient être faits par le peuple tout entier (2Ch 15:15, Ne 10:29). A ce serment de l'homme correspond, par un anthropomorphisme naturel, le serment de Dieu (cf. Ps 132:2-11 95:11, cité Heb 3:8 et suivants, Jer 11:5, Sag 12:21, Ac 2:30, Ps 110:4, cité Heb 7:21, etc.).

5. Enfin, les serments votifs, dont il était impossible de modifier la teneur, si peu que ce fût, une fois qu'ils avaient été formulés. On en trouvera, à l'article Voeu, des exemples dont celui de Jephté est le plus célèbre. Chez les Zélotes, il n'était pas rare qu'on s'engageât même par serment à commettre un meurtre si l'on pensait être agréable à Dieu en le faisant (ex., le serment votif rapporté par Ac 23:12 et suivant). Il est curieux de noter que l'un des mots usités en hébreu pour exprimer l'idée de serment provient de la racine chéba qui veut dire « sept » ; ce mot signifie littéralement : « être sous l'empire des 7 [choses sacrées] » ; on sait que le nombre 7 était sacré pour les Juifs. D'autres pensent qu'il faut voir là un reste d'influence caldéenne, les Caldéens reconnaissant 7 divinités planétaires.

D'ordinaire, et surtout dans les temps les plus anciens de l'histoire d'Israël, on jurait au nom de Dieu lui-même, et la Bible renferme une assez grande variété de formules de serments. Par ex. : « Que Dieu me traite avec la dernière rigueur si... ». (cf. 1Ro 2:23) Il faut remarquer ici le caractère indéterminé du châtiment possible, comme si l'on n'osait point le préciser, en raison même de ce qu'il pouvait avoir d'effrayant. Peut-être au début s'y mêlait-il un reste de croyance animiste : on craignait que le mauvais esprit, se croyant invoqué, ne vînt à se manifester en causant le maléfice redouté.

D'autres fois pourtant on trouve une formule plus explicite, dans le genre de celle-ci : « Que l'Éternel te traite comme Sédécias et comme Achab, que le roi de Babylone a fait rôtir au feu ! » (Jer 29:22). Les formules les plus habituelles paraissent avoir été les suivantes : « L'Éternel est témoin entre toi et moi » (Ge 31:50,1Sa 20:23. cf. 2Co 1:23, Phi 1:8, Ga 1:20) : « Que l'Éternel soit juge entre nous ! » (Ge 31:53) ; ou encore : « Le Seigneur est vivant », ou : « Aussi vrai que l'Éternel est vivant et que ton âme est vivante ! » (1Sa 20:3, cf. 2Sa 15:21) ; « Que l'Éternel soit contre nous un témoin fidèle et véridique si... » (Jer 42:5)

De même qu'on jurait par Dieu, Dieu était considéré comme jurant par Lui-même (Ge 22:16, Heb 6:13 et suivants). Plus tard, quand on n'osa plus proférer le nom divin, de crainte de le profaner et de s'attirer le terrible châtiment que devait entraîner une telle profanation, on se contenta de jurer par l'oeuvre de Dieu ou par des choses associées à son service, par les anges, par les cieux et la terre, par le soleil, par le Temple, par l'or (=les vases sacrés et le Trésor) du Temple, ou par les sacrifices ; ou encore par la vie même, considérée comme sacrée, de celui à qui l'on prêtait serment, surtout s'il s'agissait d'un roi.

La prestation de serment s'accompagnait souvent de cérémonies particulières destinées à lui donner un caractère encore plus expressif, plus solennel (ex., Jer 34:18 ; cf. Ge 15:10), ou d'un geste symbolique, dont le plus fréquent consistait à lever la main vers le ciel, demeure de Dieu (Ge 14:22, De 32:40, Da 12:7). L'acte étrange rapporté dans Ge 24:2 47:29, et par lequel au temps des patriarches on scellait un engagement d'importance, semble bien être en rapport avec le mystère de la génération, dont Dieu est la source (voir Cuisse) ; on s'engageait par là vis-à-vis de la postérité du vieillard ou du mourant.

Dans le judaïsme postérieur, les serments faits à la légère, les faux serments et les parjures se multiplièrent d'autant plus que l'expiation en était rendue plus facile par la casuistique des pharisiens. C'est ce qui explique la condamnation de tout serment prononcée par Jésus dans le sermon sur la montagne (Mt 5:34), et à laquelle fait écho l'interdiction de Jacques (Jas 5:12). M. M.
